Aster Updates Comments on Patent Family of EP 1977289

Canon’s patent enforcement campaign for the HP CC530 & CB540 series toner cartridges has attracted great attention among printing industry. Aster would like to share more analysis to help readers to understand the highly complicated patent family of EP 1 977 289.

Aster Solution

Up to this point, Aster only provides REMANUFACTURED products compatible with HP CC530 & CB540 series, which is certainly IP compliant and in abiding with the Patent Exhaustion Doctrine.  It is Aster’s opinion that the available New Build Solutions do not provide clear “work around” designs to ALL patents in this patent family. 

The Patent Family

As Aster disclosed in a previous statement, the patent EP 1 977 289 asserted by Canon has twelve counterparts in the USA, two counterparts in Europe and two pending applications in Europe.

U.S. patent numbers 10,162,304 (‘304), 7,509,071 (‘071), 7,869,740 (’740), 8,165,494 (‘494), 8,588,646 (‘646), 8,971,760 (‘760), 9,141,083 (‘083), 9,494,916 (‘916), 9,501,034 (‘034), 9,519,260 (‘260), 9,829,856 (‘856), and 9,857,763 (‘763)

EU patent numbers: EP 2884344 (‘344) and EP2889699 (‘699)

EU patent applications: EP3379341(‘341) and EP3244266(‘266)

EP 3 379 341

EP 3 379 341 is a patent application of the family of EP 1 977 289 and going to be issued by EPO. It claims that “an urging member (75, 76) including a first portion (75b) contacting with and urging said urged portion (70c), a second portion (75a) and an elastic portion (75c, 76) disposed between said first portion (75b) and said second portion (75a),
characterized in that ,
when a force is applied to said end (70d) of said force receiving member (70) when said force receiving member (70) is in the operative position, said developing frame is movable such that said developing roller is in the spaced apart position, and
said elastic portion (75c, 76) is elastically deformable when said force receiving member (70) is in the regulating position.”

This Initial Determination will automatically become a Final Determination of the ITC Commission, unless a party files a petition for review within 45 days after the Initial Determination is issued. Aster is fully prepared for any possible following proceedings and will continue supplying its customers with its IP-compliant products to benefit and protect its customers.

EP 3 379 341

EP 3 379 341 is a patent application of the family of EP 1 977 289 and going to be issued by EPO. It claims that “an urging member (75, 76) including a first portion (75b) contacting with and urging said urged portion (70c), a second portion (75a) and an elastic portion (75c, 76) disposed between said first portion (75b) and said second portion (75a),
characterized in that ,

US8588646

US8588646 is a counterpart of EP 1 977 289 in US and has a very broad protection claim stating a movable member having a spacing force receiving portion capable of receiving a spacing force to space the developing roller from the photosensitive drum, the movable member being movable relative to the frame so that the spacing force receiving portion is movable between a first position and a second position retracted from the first position toward an inside of the frame; and
an urging member configured to urge the movable member so that the spacing force receiving portion takes the first position.”

Again, based on the broad protections illustrated above, Aster has not seen a compliant solution that is truly “patent-safe.”  Aster does expect to have a design that will go into full production in the very near future.
